1. Agreement to Terms

By accessing or using the Ware website at wareglaze.com (the “Site”) and any services provided through it (the “Services”), you agree to be bound by these Terms of Service (“Terms”). If you do not agree to these Terms, do not use the Site or Services.

2. Description of Services

Ware provides a custom ceramic glaze design and ordering service. Users can select colors, specify firing parameters, and order custom-formulated glazes in dry powder or pre-mixed form. Glazes are crafted to order and shipped to the address you provide.

3. Accounts

You may need to create an account to use certain features. You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate and complete information
  • Keep your login credentials secure
  • Notify us immediately of any unauthorized access
  • Accept responsibility for all activity under your account

We reserve the right to suspend or terminate accounts that violate these Terms or that we reasonably believe are being used fraudulently.

4. Orders and Payment

All orders are subject to acceptance and availability. Prices are listed on the Site and may change without notice. You agree to pay all charges associated with your order, including applicable taxes and shipping fees.

Because our glazes are custom-formulated to your specifications, all sales are final once production has begun. See our Refund Policy (Section 6) for details on exceptions.

5. Custom Products

Ceramic glazes are inherently variable. While we formulate each batch from tested recipes and strive for accurate color matching, you acknowledge that:

  • Final fired color may vary based on your clay body, kiln conditions, application thickness, and firing schedule
  • Screen colors are approximations — monitors display colors differently than fired ceramics
  • Minor batch-to-batch variation is normal and expected in ceramic glazes
  • We recommend test-firing a sample before glazing finished work

These inherent variations do not constitute a defect and are not grounds for a refund.

6. Refunds and Returns

Because our products are custom-made, we generally cannot accept returns. However, we will work with you if:

  • Your order arrives damaged or contaminated
  • You received the wrong glaze or an incorrect batch size
  • The product is materially defective (e.g., fails to melt at the specified cone)

Contact us within 30 days of delivery to report any issues. We may offer a replacement batch, store credit, or refund at our discretion.

7. Safety and Intended Use

Our glazes are intended for use by experienced ceramic artists and hobbyists. You agree to:

  • Review the Safety Data Sheet (SDS) provided with each glaze before use
  • Follow all handling, mixing, and firing instructions
  • Use appropriate personal protective equipment (gloves, dust mask, eye protection) when handling dry glaze materials
  • Fire glazes only in properly ventilated kilns
  • Not use glazes in ways inconsistent with their intended purpose

Unless independently tested and confirmed food-safe by the user, glazes should not be assumed suitable for surfaces that contact food or drink. We do not certify any glaze as food-safe.

8. Intellectual Property

All content on the Site — including text, graphics, logos, images, glaze formulations, software, and the design tool — is owned by Ware or its licensors and is protected by copyright, trademark, and other intellectual property laws.

You may not copy, reproduce, distribute, modify, create derivative works from, publicly display, or commercially exploit any Site content without our prior written consent.

Glaze recipes: When you purchase a glaze, you receive the physical product. The underlying recipe, formulation, and methodology remain our proprietary information and trade secrets. You may not reverse-engineer, analyze, or attempt to derive the composition of our glazes for the purpose of reproduction or commercial resale.

Your content: You retain ownership of photos, reviews, and other content you upload. By posting content on the Site, you grant us a non-exclusive, royalty-free, worldwide license to use, display, and reproduce that content in connection with operating and promoting the Site.

9. Limitation of Liability

To the fullest extent permitted by law, Ware and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or goodwill, arising from:

  • Your use of or inability to use the Site or Services
  • Any product purchased through the Site, including damage to ceramic work
  • Unauthorized access to or alteration of your account or data
  • Any third-party conduct on the Site

Our total liability for any claim arising from these Terms or your use of the Services shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Disclaimer of Warranties

The Site and Services are provided “as is” and “as available” without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, error-free, or free of harmful components, or that any glaze will produce a specific color result in your specific firing conditions.

11. Indemnification

You agree to indemnify, defend, and hold harmless Ware and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys’ fees) arising from your use of the Site or Services, your violation of these Terms, or your violation of any rights of a third party.

12. Prohibited Conduct

You agree not to:

  • Use the Site for any unlawful purpose or in violation of any applicable law
  • Interfere with or disrupt the Site, servers, or networks
  • Attempt to gain unauthorized access to any part of the Site
  • Scrape, crawl, or use automated means to access the Site without our written permission
  • Reverse-engineer, decompile, or disassemble any part of the Site or its software
  • Resell or commercially redistribute our products or recipes without authorization
  • Submit false or misleading information

13. Governing Law and Disputes

These Terms are governed by the laws of the State of New Hampshire, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in Merrimack County, New Hampshire, and you consent to personal jurisdiction in those courts.

14. Modifications to Terms

We may revise these Terms at any time by updating this page. Your continued use of the Site after changes are posted constitutes acceptance of the revised Terms. We encourage you to review this page periodically. Material changes will be noted by updating the “Last updated” date at the top of this page.

15. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will continue in full force and effect.
