Ware Terms of Use

Ceramic Materials Workshop, Inc. (“CMW,” “we,” “us,” or “our”) offers and maintains Ware, a brand of CMW, including the Ware mobile application (available through the Apple App Store and Google Play), the Ware website pages, ordering flows, customer support channels, and related products and services (collectively, the “Ware Services”), for the use of authorized users, customers, vendors, students, and other users (“Users,” “you,” or “your”).

Please read these Terms of Use carefully before using the Ware Services. By accessing or using Ware, creating an account, submitting order information, or placing an order, you accept these Terms of Use and form a binding agreement with CMW. If you do not agree to these Terms of Use, do not access or use the Ware Services.

You must be at least 18 years of age to create an account, use the Ware Services, or place an order through Ware. By creating an account or placing an order, you represent to CMW (and CMW is relying upon) that you are at least 18 years old and that you are legally able to enter into a binding agreement and comply with these Terms. Ware is not directed to or intended for use by children under 18, and CMW does not knowingly collect information from children under 18.

You agree to provide accurate, current, and complete account, order, billing, shipping, and contact information. You are responsible for maintaining the confidentiality of your login credentials and are responsible for all activity under your account. You must promptly notify CMW if you believe your account has been accessed without authorization or if the confidentiality of your login credentials has been compromised.

CMW provides Ware to support glaze-related ordering, information, communication, customer support, and related services. The Ware mobile application is offered without charge other than your agreement to be bound by these Terms. CMW authorizes each User to access and use Ware for personal, educational, studio, or internal business purposes, subject to these Terms. CMW reserves the right to revoke access for any User at any time, with or without notice, for any reason or in the absence of a reason.

You may not modify, reproduce, share, distribute, scrape, resell, reverse engineer, interfere with, or use Ware, its content, its software, its formulations, its data, or its materials for unauthorized commercial purposes without CMW’s prior written permission. Any breach of these Terms (even if CMW is unaware) automatically terminates your authorized use of Ware without any requirement of notice.

Ware glazes are custom products prepared based on order information, selected options, and/or information supplied by you. You are responsible for reviewing your order carefully before submitting it, including glaze selection, clay-body information, firing range, quantity, shipping address, and any notes or specifications.

CMW may review orders before batching and may contact you for clarification. CMW may decline, cancel, or modify an order if information is incomplete, materials are unavailable, the requested product or use case raises safety, quality, technical, legal, or practical concerns, or the order cannot reasonably be fulfilled or for any other reason as determined by CMW in its sole and absolute discretion. Orders are not binding upon CMW until accepted.

For purposes of Ware orders, “batching” means the point at which CMW begins preparing, measuring, mixing, producing, or otherwise processing the custom glaze or related custom product for your order. Once batching begins, the order is custom-made and subject to the Ware Refund Policy.

Any fulfillment, batching, shipping, or delivery dates are estimates unless CMW expressly states otherwise in writing. You are responsible for providing accurate shipping information and for promptly contacting us about any order issue.

Ware orders are subject to the Ware Refund Policy posted in the Ware Services. Because each Ware glaze is custom made for you, orders may not be returned, cancelled, or refunded once batching has begun, except as required by law or expressly approved by CMW in writing.

Cancellation requests must be submitted within 24 hours after payment and before batching begins. To request cancellation, contact info@ceramicmaterialsworkshop.com with your order number. CMW’s records will determine whether the cancellation request was received within the cancellation period and whether batching had begun.

If your order arrives damaged, is incorrect, or is lost in transit, CMW will replace the affected order subject to the conditions in the Ware Refund Policy.

Ceramic materials, glazes, testing conditions, kilns, clay bodies, firing schedules, application methods, and studio environments vary widely. Ware may provide glaze-related information, product options, custom batching, recommendations, or support, but final results depend on conditions outside CMW’s control.

Safety Data Sheets (SDS) for Ware glazes are available for download through the Ware app and the Ware website. You are responsible for reviewing the applicable SDS before handling, mixing, applying, firing, or otherwise using any Ware glaze, and for following all safety information, warnings, ventilation practices, personal protective equipment requirements, material-handling practices, and laws or regulations that apply to your use of ceramic materials.

You are solely responsible for determining whether any Ware glaze, material, information, or recommendation is suitable for your intended clay body, kiln, firing schedule, application method, surface, food-contact use, production process, studio environment, sale, or other use. You should perform appropriate tests before using any glaze on finished work, work for sale, functional ware, food-contact surfaces, architectural applications, public installations, or other critical uses.

Unless CMW expressly states otherwise in writing, Ware glazes and information are not a guarantee of food safety, leach resistance, durability, fit, color, surface, thermal performance, safety certification, regulatory compliance, or fitness for any particular purpose.

Ware, the Ware Services, the CMW website, text, images, videos, graphics, software, user interfaces, designs, course materials, articles, glaze-related tools, recipes, analyses, recommendations, formulations, databases, know-how, trademarks, service marks, and other content provided by CMW are owned by CMW or its licensors and are protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

No license or ownership rights are transferred to you or granted by your use of Ware, creation of an account, submission of an order, or purchase of a product, except for the limited right to use Ware as authorized by these Terms. You may not copy, sell, license, distribute, publish, or claim ownership of CMW content or materials without prior written permission from CMW.

You retain ownership of photos, notes, test results, comments, and other content you submit to Ware, except for CMW content incorporated in or derived from the Ware Services. By submitting content or information through Ware, you grant CMW a non-exclusive, worldwide, transferable, royalty-free license to use, reproduce, store, process, modify, display internally, analyze, and create derivative works from that content as reasonably necessary to operate Ware, fulfill orders, provide support, improve and market/promote CMW services, and protect CMW and its users.

CMW will not intentionally publish your identifiable customer content for marketing, social media, advertising, or public educational purposes without your permission, unless you submit the content to a feature that is expressly public or otherwise authorize public sharing.

You represent that you have the right to submit any content or information you provide to Ware and that your submission does not violate any law, contract, confidentiality obligation, intellectual property right, privacy right, publicity right, or other right of any third party. You agree to indemnify, defend, and hold harmless CMW and its officers, owners and employees from and against any and all claims or liabilities arising or resulting from any content or information you provide to Ware.

You agree not to:

• Use Ware for any unlawful, fraudulent, harmful, abusive, harassing, defamatory, infringing, misleading, or unauthorized purpose.
• Submit false, inaccurate, incomplete, or misleading account, order, payment, shipping, or technical information.
• Interfere with Ware’s security features, access controls, systems, networks, servers, software, app functionality, or other users.
• Attempt to gain unauthorized access to Ware, user accounts, CMW systems, source code, nonpublic information, or third-party systems.
• Reverse engineer, decompile, disassemble, scrape, crawl, copy, benchmark, or create derivative products from Ware or CMW content except as permitted by law.
• Upload viruses, malware, code, files, or content that could damage or interfere with Ware or any third-party system.
• Use Ware to develop competing products or services, copy CMW content, or misuse CMW’s formulations, tools, data, or recommendations.

The Ware Services, Ware content, glaze-related information, recommendations, order tools, and products are provided “as is” and “as available” to the fullest extent permitted by law. CMW disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, likely results, uninterrupted availability, and reliability.

CMW does not warrant or represent that Ware, any Ware glaze, any formulation, any recommendation, any material, or any information will meet your requirements, produce a particular result, be suitable for a specific use, or be free from errors, variations, defects, contaminants, or safety concerns. You are responsible for testing and verifying all results before use.

To the fullest extent permitted by law, CMW and its owners, employees, contractors, officers, directors, agents, affiliates, and service providers will not be liable for any indirect, incidental, consequential, special, exemplary, punitive, or similar damages, including loss of profits, damage to goodwill, loss of data, loss of business, business interruption, kiln damage, studio damage, failed work, production losses, personal injury, property damage, or losses arising from use of or inability to use Ware, Ware content, Ware glazes, recommendations, or products, even if CMW has been advised of the possibility of such damages.

To the fullest extent permitted by law, CMW’s total liability for any claim arising out of or relating to Ware, these Terms, or any Ware product or service will not exceed the amount you paid to CMW for the specific Ware order or service giving rise to the claim, or one hundred dollars ($100), whichever is greater.
