Ware Mobile Privacy Policy

1. Scope of This Privacy Policy

This Privacy Policy explains how Ceramic Materials Workshop, Inc. (“CMW,” “we,” “us,” or “our”) collects, uses, and discloses your Personal Information, which is any information that relates to an identified or identifiable natural person, or as otherwise defined under applicable law (“Personal Information”), that is collected from you when you access, use, or interact with Ware, a brand of CMW, including through the Ware mobile application (available through the Apple App Store and Google Play), Ware website pages, ordering flows, customer support channels, and related products and services (collectively, the “Ware Services”).

Ware allows users to access glaze-related information, create or submit custom glaze order information, communicate with CMW, and purchase custom-batched Ware glazes and related services. Ware ships to U.S. addresses only. By accessing or using the Ware Services, you consent to the collection and use of information as described in this Privacy Policy.

Please read this Privacy Policy carefully. By using or interacting with the Ware Services, you acknowledge that you have read, understood, and agree to be bound by the terms of this Privacy Policy and consent to our collection, use and disclosure of Personal Information and other information as set forth herein. If you do not consent to the terms of this Privacy Policy, you should not access or use the Ware Services in any way and should immediately exit the Services. This Policy is incorporated into and subject to our Terms of Use.

Privacy Policy Updates

We may periodically revise this Privacy Policy at any time, by posting an amended Privacy Policy on the Site. We encourage users to review this Privacy Policy periodically. Your continued access to or use of the Ware Services after changes are posted will be deemed acceptance of those changes to the extent permitted by law.

2. Information We Collect

Personal Information You Provide

We may collect Personal Information that you voluntarily provide to us through the Ware Services. This may include:

  • Name, email address, phone number, username, password, and account login credentials.
  • Billing address, shipping address (U.S. only), order number, order history, customer support messages, and related transaction information.
  • Studio, school, or business information that you choose to provide.
  • Marketing preferences, newsletter signups, survey responses, and other communications you submit to us.
  • Photos, comments, notes, test results, glaze goals, clay-body details, firing temperature, firing atmosphere, kiln information, surface/color preferences, batch-size requests, and other custom glaze or ceramics information you choose to submit.

You may choose not to provide Personal Information, but doing so may prevent you from creating an account, placing an order, receiving support, or otherwise using Ware Services.

Order, Glaze, and User-Submitted Ceramic Information

Because Ware involves custom glaze ordering, we may collect and store information about your glaze requests and related ceramic use cases. This may include order specifications, formulation requests, ingredient limitations, color and surface goals, batch sizes, test feedback, photos, and other information needed to prepare, support, improve, or document your order.

We may use this information to fulfill your order, provide customer service, improve Ware, improve our glaze-related tools and processes, and develop aggregated or anonymized insights. We will not intentionally disclose your identifiable custom order details publicly unless you authorize us to do so, submit them to a public feature, or disclosure is otherwise permitted by this Privacy Policy.

Payment Information

Payments through Ware are processed by Stripe, our third-party payment processor. Stripe collects and processes the information necessary to complete the transaction, including payment details, billing information, and transaction records, subject to Stripe’s own privacy policy and terms. CMW does not store full credit card numbers or banking account information on our own systems. We may receive limited transaction information from Stripe (such as the last four digits of the card, payment status, and order amount) to administer your order and maintain business records. You may receive emails or other communications from Stripe or from us regarding your transactions and payments.

Use Data, Device Data, and Analytics

When you access or use the Ware Services, certain information may be automatically created, collected, and recorded (“Use Data”). Use Data may include:

  • IP address, approximate geographic location derived from IP address, browser type, operating system, device type, mobile device identifiers, app version, and referring pages.
  • Pages, screens, features, and actions used within the Ware Services; session dates and times; click paths; crash logs; diagnostic data; and performance data.
  • Cookie, web beacon, local storage, software development kit (SDK), and analytics data, including information collected through tools such as Google Analytics or similar analytics services.

We may use cookies, web server logs, analytics tools, and mobile analytics SDKs to understand how users find and use Ware, administer the Ware Services, diagnose technical issues, improve features, and support marketing and business analysis.

Cookies are small files that are stored on your computer and automatically collect certain information from you. We may use the following types of Cookies: (i) strictly necessary cookies which are necessary for the Ware Services to function; and (ii) analytics cookies which allow us to identify traffic sources. We also use local storage for user-specific information such as shopping carts.

Most browsers provide you with the ability to block, delete, or disable cookies. If you choose to reject cookies, some features and functionality of the Ware Services may be limited or unavailable. Location, Camera, Photos, and Notifications

Ware may request permission to access certain mobile device features only if those features are needed for the app experience. For example, Ware may request access to photos or camera if you choose to upload images related to glaze testing or an order. Ware may request permission to send push notifications for order updates, customer service, reminders, or marketing messages.

Unless expressly stated in the app or enabled by you through your device settings, Ware is not intended to collect precise GPS location. You can manage mobile permissions through your device settings. Disabling permissions may limit certain app features.

3. How We Use Collected Information

CMW may use information collected through Ware for purposes including:

  • Creating, maintaining, and securing user accounts.
  • Providing, operating, personalizing, and improving the Ware Services.
  • Reviewing, confirming, batching, fulfilling, shipping (to U.S. addresses), and supporting custom glaze orders.
  • Communicating with you about account activity, orders, cancellations, customer support, updates, policy changes, and service announcements.
  • Sending newsletters, offers, educational content, surveys, or marketing communications when permitted; each marketing email will provide an opportunity to opt out of future marketing email correspondence.
  • Analyzing user activity and aggregate trends to improve Ware, CMW services, technical performance, and customer experience.
  • Detecting, preventing, and responding to fraud, misuse, unauthorized access, security incidents, policy violations, and legal claims.
  • Complying with law, legal process, accounting obligations, tax obligations, and business recordkeeping requirements.

4. How We Share Information

We may share Personal Information, Use Data, or aggregated/anonymized information as described below.

Service Providers

We may share information with trusted third-party service providers that perform functions or provide services for us, such as hosting, app infrastructure, database storage, analytics, crash reporting, payment processing (Stripe), order management, shipping, email delivery, marketing, customer support, legal, accounting, and professional services. We share information only to the extent reasonably necessary for those providers to perform services for us, subject to appropriate confidentiality and data-security obligations where applicable.

Payment, Shipping, and Fulfillment Providers

If you place an order, Stripe and our shipping, tax, and fulfillment providers may receive information needed to process payment, prepare and ship the order, track delivery, handle tax or accounting obligations, and provide customer support.

Legal, Safety, and Business Transfers

We may disclose information to government agencies, advisors, courts, law-enforcement authorities, or other third parties when necessary or appropriate to comply with applicable law, respond to legal process, protect CMW’s rights or property, prevent fraud or misuse, protect the safety of users or the public, enforce our Terms of Use or other policies, or in connection with a financing, sale, acquisition, merger, reorganization, bankruptcy, or transfer of all or part of our business or assets.

Aggregated or Anonymized Information

We may share aggregated, de-identified, or anonymized information that does not directly identify you, including aggregate order trends, app usage statistics, and generalized glaze or ceramics insights.

5. Third-Party Websites, Platforms, and App Stores

The Ware Services may contain links to third-party websites, applications, social media platforms, payment services (such as Stripe), app stores (Apple App Store and Google Play), or other services (collectively, “Third-Party Services”). Once you leave Ware or are redirected to a Third-Party Service, you are no longer governed by this Privacy Policy. Your interaction with Third-Party Services is governed by the privacy policies and terms of use of those Third-Party Services, and CMW is not responsible for their policies and practices.

The Apple App Store and Google Play may also collect information about downloads, app usage, purchases, device identifiers, crash reports, and account activity under their own policies. You should review the privacy practices and policies of those third parties before providing Personal Information to them.

6. Security

We strive to use appropriate security measures and to use service providers that follow industry standards to protect the privacy and security of your Personal Information. However, no e-commerce solution, website, mobile application, database, system, method of transmission over the Internet, or method of electronic storage is completely secure or “hacker proof,” and we cannot guarantee the security of Personal Information, or that unauthorized access, hacking, data loss or other breaches will never occur. You are also responsible for taking reasonable steps to protect your Personal Information against unauthorized disclosure or misuse. WE EXPRESSLY DISCLAIM ANY REPRESENTATION OR WARRANTY, WHETHER EXPRESS OR IMPLIED, WITH RESPECT TO ANY BREACHES OF SECURITY, DAMAGE TO YOUR DEVICE, OR ANY LOSS OR UNAUTHORIZED USE OF YOUR PERSONAL INFORMATION OR OTHER DATA. USE OF THE WARE SERVICES IS AT YOUR OWN RISK.

7. Data Retention

We retain your Personal Information for as long as reasonably necessary to fulfill the purposes for which it was collected, including to provide the Ware Services, fulfill orders, maintain business and accounting records, comply with legal obligations, resolve disputes, enforce agreements, improve our services, and protect against fraud, misuse, and security incidents, or for the period legally permitted or required. We may retain aggregated or anonymized information indefinitely.

8. Age Requirement and Children’s Privacy

Ware is intended for users who are at least 18 years of age. You must be at least 18 years old to create an account, place an order, or use the Ware Services. Ware is not directed to or intended for use by children under the age of 18, and we do not knowingly collect Personal Information from children under 18. If we learn that we have collected Personal Information from a child under 18, we will take appropriate steps to delete that information.

9. Your Choices

Account information: You may be able to review or update certain account information in the Ware app or by contacting us.

Marketing emails: You may unsubscribe from marketing emails using the opt-out link included in those emails. We may still send non-marketing messages related to your account, orders, service updates, policy changes, or legal notices.

Push notifications: You can manage push notification permissions through your mobile device settings.

Mobile permissions: You can manage camera, photo, notification, and other device permissions through your mobile device settings.

Withdrawal of consent: If you no longer consent to our collection or use of information needed to provide Ware, you may contact us. Withdrawing consent may require termination of your account or access to some or all Ware Services.

10. Do Not Track and Mobile Privacy Controls

Some browsers or devices may transmit “Do Not Track” or similar signals. At this time, CMW does not alter its data collection and use practices in response to Do Not Track signals. Ware may respond to Apple App Store, Google Play, or operating-system privacy settings where required by applicable platform rules or law.

11. Your Rights

Depending on your U.S. state of residence, you may have certain rights related to your Personal Information, including the right to access, correct, transfer, or delete such information, to object to certain processing, and to opt-out of sale or sharing. To inquire about these rights, please contact us through one of the methods listed in the Contact section of this Privacy Policy. Note that rights vary by state and these rights may be inapplicable to the Ware Services.

12. International Transfers

The Ware Services are operated from our offices in the United States. If you access the Ware Services from outside of the United States, you acknowledge and agree that your Personal Information may be transferred to and maintained on computers and servers located outside of your jurisdiction where the privacy laws may be different from those in your jurisdiction. If you choose to use the Ware Services, you freely and specifically consent to the transfer of your Personal Information, including automatically collected information, outside of your jurisdiction and the collection, use and potential disclosure of such information in accordance with the laws of that jurisdiction and this Privacy Policy.
